St. Joseph family settles case in man's death

(ST. JOSEPH, Mo., AP) — The family of a St. Joseph man killed in a 2011 accident at a repair shop has settled a lawsuit against Herzog Railway Services.
A Buchanan County judge approved a $1.45 million settlement Monday in the death of 40-year-old Robert Montgomery. He died in May 2011 when a piece of equipment fell on him while he was working on a rail car at Herzog’s repair shop.
The St. Joseph News-Press reports (http://bit.ly/15aeIFh) as part of the settlement, Montgomery’s wife agreed that a workers’ compensation case filed in a Missouri administrative court will be dismissed.
Herzog, which is based in St. Joseph, does construction and railroad business across the country.
